WINNING POST JUMPS RACING COMPETITION
TERMS AND CONDITIONS

Entry into this competition is deemed acceptance of these Terms and Conditions.
1.    Prize and Competition Details
a.    The Winning Post Jumps Racing Competition consists of two (2) individual competitions (each a ‘Competition’). There will be only one prize awarded in each Competition.
b.    The total prize pool for the Winning Post Jumps Racing Competition is valued at approximately AUD$3,000.00, consisting of two (2) prizes each valued at AUD$1,500.00, being one prize for each Competition.
c.    The winner of each Competition will receive a 70-inch TCL 70C2US television valued at approximately AUD$1,500.00 (‘the Prize’).
d.    The Prize must be taken as prescribed and is neither exchangeable nor redeemable for cash. Racing Victoria accepts no responsibility for any variation in the value of the Prize (or part thereof).
e.    The competition period for each Competition is as follows:
i.    The first Competition commences at 06:00 am on 19 July 2019 (AEST) and closes at 01:00 pm on 21 July 2019 (AEST) (‘First Competition’); and
ii.    The second Competition commences at 06:00 am on 23 August 2019 and closes at 01:00 pm on 25 August 2019 (‘Second Competition’),
(each a ‘Competition Period’).
2.    How to Enter
a.    Entry is open to all Australian residents over the age of 18 years.
b.    With respect to each Competition, to enter that Competition eligible entrants must submit an answer to the question posed (each a ‘Question’) to Racing Victoria either via email to prichards@winningpost.com.au or via post to “Winning Post Jumps Racing Competition, Racing Victoria, 400 Epsom Road, Flemington, Victoria 3031”, during the Competition Period. All entries must also include your full name, address, email address and telephone number in order to be eligible.
c.    The correct answer to each Question will be determined by Racing Victoria at its sole discretion and published in Winning Post after the conclusion of the relevant Competition Period.
d.    Only eligible entrants who answer the Question correctly will be entered into the prize draw for the relevant Competition.
e.    The Question for each Competition will be published in Winning Post on the following dates:
i.    First Competition: 20 July 2019; and
ii.    Second Competition: 24 August 2019.
f.    You may enter each Competition only once. You may enter one or both of the Competitions. However, for the avoidance of doubt, you must submit a separate entry for each Competition in order to be eligible.
g.    Racing Victoria has no liability for lost or misdirected competition entries submitted via post. Any entries received by Racing Victoria after the Competition Period are ineligible.  
h.    Neither employees, nor any family members of employees, of Racing Victoria, its related companies, their agents or those of their respective group companies or any supplier, provider or agency associated with this competition may take part in this competition.
i.    Racing Victoria may in its absolute and sole discretion disqualify an entry.  Any decision by Racing Victoria to disqualify an entry is final and no correspondence will be entered into.
3.    Privacy and Use of Personal Information
a.    All personal information will be treated in accordance with Racing Victoria’s Privacy Policy, available at: https://www.racingvictoria.com.au/privacy-policy.
b.    Each entrant's personal information is collected to enable Racing Victoria to administer and promote this competition and the winner. The personal information of the winner may be provided to third parties who are assisting Racing Victoria, including prize suppliers, deliverers and authorities that regulate competitions.
c.    By entering this competition you also agree to Racing Victoria providing your personal details to the Australian Jumps Racing Association (‘AJRA’) for the purpose of being registered on its database. You may be contacted by AJRA for promotional purposes or for the purpose of providing you with general updates/news relating to AJRA.
4.    General
a.    With respect to each Competition, all eligible entrants with respect to that Competition (who have answered the Question correctly) will be entered into a prize draw, from which the winner will be randomly selected via a manual draw at Racing Victoria’s offices, located at 400 Epsom Road, Flemington, Victoria 3031 at 10:00 am (AEST) on the following dates:
i.    First Competition: Monday, 22 July 2019; and
ii.    Second Competition: Monday, 26 August 2019.
No correspondence will be entered into in relation to the drawing of prizes.
b.    The winner of each Competition will be notified by email (and where possible, via telephone) within two (2) business days of the drawing of the prize and the winner’s name and address will be announced in the next available edition of Winning Post and on the Winning Post website at: winningpost.com.au. The winner’s name and address will be published on the Winning Post website for at least twenty-eight (28) days.
c.    If, after the passage of three (3) months since the date of the original draw, the Prize has not been claimed by the winner, the Prize will be forfeited and an alternate winner will be randomly selected from all remaining (non-winning) eligible entries.
d.    Within fourteen (14) days of being notified by Racing Victoria as the winner or within fourteen (14) days of claiming the Prize, whichever is sooner, the winner must provide Racing Victoria with proof that they are (and were at the time of entry) an Australian resident and over 18 years of age.
e.    If the winner fails or is unable to provide the necessary proof of eligibility as per the above clause or fails to do so within the time period specified above, Racing Victoria may declare that person ineligible. If the winner is declared ineligible in accordance with this clause or for any other reason, the Prize will be forfeited and an alternate winner will be randomly selected from all remaining (non-winning) eligible entries.
f.    The Prize will be sent by courier to the winner, at the address provided in the winner’s entry, unless otherwise agreed in writing between the winner and Racing Victoria. Racing Victoria takes no responsibility for a prize lost or damaged in transit. Racing Victoria will provide the winner’s name and contact details to the courier for the purpose of facilitating delivery of the Prize.
g.    Racing Victoria accepts no responsibility whatsoever for any system or connection problems that might affect any end user during this competition.
h.    Racing Victoria is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the Internet or at any website, or any combination thereof, including any injury or damage to participants or any other person's computer related to or resulting from participation in or downloading any materials in this competition.
i.    Racing Victoria and its related companies and subsidiaries, or any of their employees, officers or directors shall not be liable for any damages howsoever arising as a result of a participant’s entry into this competition or a winner's (and his or her guests) acceptance of a Prize and any such liability shall be borne solely and exclusively by the participant or winner (and his or her guests), as the case may be.
j.    If for any reason the competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of Racing Victoria, which corrupt or affect the administration security, fairness or integrity or proper conduct of this competition, Racing Victoria reserves the right in its sole discretion to disqualify any individual who tampers with the entry process or to cancel, terminate, modify or suspend the competition.
k.    Racing Victoria reserves the right in its sole discretion to disqualify any individual whom Racing Victoria has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the competition.
l.    If either of the below circumstances are met, Racing Victoria reserves the right to substitute the original prize for a prize that is of the same or greater value than the original prize:
i.    the winner agrees to the substitution in writing; or
ii.    the original prize is unavailable due to circumstances beyond Racing Victoria’s control and Racing Victoria has made reasonable attempts to reach agreement with the winner but those attempts have been unsuccessful.
m.    This competition shall be governed by and construed with reference to the laws in force in the State of Victoria and entrants submit unconditionally to the jurisdiction of the appropriate courts of the State of Victoria.
